Terms of Service

Welcome to Agentele ("the Service"), operated at agentele.ai. By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.

1. What Agentele is

Agentele is a messaging platform where every contact is an AI agent that you create and configure. Agents can chat, hold voice calls, remember what you tell them, and reach out proactively on schedules you define. Every agent is artificial intelligence, not a human being. This is disclosed throughout the product and agents will confirm it if asked.

2. Eligibility

You must be at least 18 years old to use the Service. By signing up you confirm that you are 18 or older.

3. Your account

• You are responsible for keeping your credentials secure.
• New accounts may require approval before full access is granted.
• One account per person; accounts are not transferable.

4. Credits and billing

• The Service is sold as plans (Free, Plus, Pro and Own Key) shown on the pricing page. A paid plan bought by card, PayPal or wallet is a subscription processed by Paddle, our merchant of record: it renews at the end of each monthly or yearly period until you cancel, which you can do at any time from the link in your Paddle receipt; cancelling keeps the plan until the period already paid for ends. A plan paid by bank transfer runs for the period paid and then lapses back to Free unless renewed. Your agents and their memories are kept either way.
• Every new account starts with a 7-day free trial of Plus. No card is required.
• Plans cover messages and voice within the fair-use limits stated on the pricing page.
• You may instead bring your own AI provider API key ("BYOK"); usage under your own key is billed by your provider, not by us.
• Promotional or gifted credits have no cash value and may carry an expiry date.
• Refunds are governed by our refund policy.

5. Acceptable use

Agentele is for adults, and agents are assistants and companions — not for sexual or romantic roleplay. You agree not to use the Service, its agents, Aria, voice calls or portraits to create, request or help with:

• sexual content involving minors — anything sexual or sexualised involving anyone under 18, including fiction, roleplay or drawings. Zero tolerance;
• sexual or explicit content — explicit sexual material, nude or sexual images, or sexual roleplay;
• violence — planning or carrying out harm to people, or making, acquiring or modifying weapons or explosives to hurt someone;
• illegal drugs — making, buying, selling or smuggling them;
• fraud — scams, phishing, forged documents, financial fraud, or impersonating real people or organisations to deceive;
• hacking — breaking into, spying on or disrupting systems, accounts or devices that are not yours, or writing malware;
• hate and harassment — threats against real people, targeted harassment, or attacks on people for who they are;
• non-consensual intimate imagery — creating, obtaining or sharing intimate images of a real person without their consent, including "deepfakes" and sextortion;
• extremism — propaganda, recruitment or support for terrorist or violent extremist groups;
• privacy invasion — stalking, secretly tracking someone, or exposing their private information (doxxing).

Nor may you:

• break any other law, or generate content that is illegal where you live;
• attempt to breach, probe, or overload our systems or other users' data;
• resell access to the Service without our written consent.

Fiction, education, news, harm-reduction questions and learning about security are welcome, as long as they are not a way to obtain real-world instructions for the above. Medical, legal or mental-health questions are never a breach.

How this is enforced. Messages, voice-call transcripts and portrait descriptions are checked automatically as they are sent (see the privacy policy, §6b). An agent declines a request that crosses one of these lines and says so once. Clear misuse is recorded and may be reviewed by us; we may suspend or terminate accounts that break these rules. Sexual content involving minors suspends the account immediately, pending review. Someone who tells an agent they may hurt themselves has broken no rule: they are offered support, never penalised.

6. AI limitations and safety

• Agents can be wrong. Output is generated by AI models and may be inaccurate, incomplete, or inappropriate despite our safeguards. Do not rely on agents for medical, legal, or financial decisions.
• Agents are companions and assistants, not emergency services. If you are in crisis, contact local emergency services or a crisis hotline.
• Agents you create reach out on a schedule by default. Every proactive message carries a one-tap stop link, there is a daily cap you control in Settings, and any schedule can be turned off or deleted at any time.

7. Your content

You own the content you submit and the agent configurations you create. You grant us the license needed to operate the Service (storing, processing, and transmitting your content to AI model providers to generate responses). We do not use your conversations to train our own models. See the privacy policy for details.

8. Termination

You can delete your account at any time from Settings, which permanently removes your data as described in the privacy policy. We may suspend or terminate accounts for breach of these terms. Remaining purchased credits on accounts terminated for breach are forfeited; otherwise the refund policy applies.

9. Disclaimers and liability

The Service is provided "as is" during its beta period. To the maximum extent permitted by law, we disclaim all warranties and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

10. Changes

We may update these terms as the Service evolves. Material changes will be announced in the app; continued use after a change means you accept the new terms.
